The New Dauben Narrative Begins

Its similar to the old one but with a new twist: we just want to get started with our new lives together and raise a family.

Joey and Presley still plan on starting a family together. Presley said:
"Joey is confident, and he knows what he has got to do," Crowe said in a phone text. "He's ready to at least get all of this behind us, and get our life going so that maybe one day we can start a family. That idea and the thought of being with his family with no restriction is what is keeping him going."

Wait what? What does he have to do? Does she think he's about to go change in a phone booth or is this like the final words of a terrorist? Or does she know what he is about to do? 10-15 years hard time and registered sex offender.

"I just hope we can get the dollars to get him out of Navarro County Jail before his trial there, but who knows how it will pan out," Crowe said.

Yes Presley, here in America we use dollars, pesos or yen wont cut it. She speaks of acquiring money like its some ancient form of mysticism. "Well we prayed to the gods, I poured the oil on the candlewick and now we are waiting for these dollars to appear".

I think one of the restrictions that comes from the Navarro case should be that he is banned from procreation. The Dauben name must end with him, its certainly not fair to any child to bring them in to the world with terrible parents like Presley and Joey would be, the cycle must end here.

  1. Please educate me. I though the max jail time was 2 years for a state jail felony. How can probation run for 5 years, and if he violates it, he could serve 5 years?

    Also if the judge knew Joey for years before the trial, how is this a fair trial?

    Not defending Joey, don't take it that way. I'm a defender of the constitution and am concerned. I know he pissed a lot of people off. I know a jury convicted him, but the judge knew him well, and the prosecutor had history with Joey as well....

    Just concerned about a fair trial.

  2. I'm not sure but I think that he has 5 years probation and if he violates it he gets two years in jail. Carroll knew Joey but to say he was impartial is another matter. And if he wanted to make the case Joey could have, he could have argued for a different judge or even a change in venue. That would have been up to him. But no matter where he moved it, outside of the banana republic, Joey was going to be convicted and have at least 2 years probation. And I think as others have pointed out, if he had a better attitude and showed true remorse for his crime, his sentence would have been much smaller. I think in Joey's little head he is happier to have been convicted in ellis county by bob and patrick, it fits his conspiracy prophecies to whatever remaining daubenistsas he has.

  3. Well this trial, though makes a lot of people "breathe" some relief, as the credibility of what he has written without doubt will be harmed...

    It is SMALL potatoes compared to the next trial.

    When I was 19 years old (early 90's) I had a friend who just turned 18, and had a girlfriend who was 15 (who was JUST about 16 by three weeks). They had been bf/gf for a while.

    Anyway, they did stuff, and her parents freaked out. They called the cops, then dropped the charges the next day. The cops picked up the charges.

    My friend was arressted, spent 3 months in Jail, and then was given a few years probation. Anyway, all was well for two years. He married the girl, and they were married for 1 year.

    Soo... still on probation, him and his wife visited some friends who had a bong in their home during a small party. Cops were called out, and they weren't even smoking it.

    Needless to say, he gets busted back, and had to spend a year of his life in Huntsville.

    Why? He had sex with his future wife and couldn't use the 2 years in age excuse over about 2 months. (2 years 2 months).

    Oh yes, all the while, he was a registered Sex Offender (and I think he still is but I dunno).

    If Joey is convicted of:
    26 years old (certainly the age of an adult)
    CHURCH CAMP (morals?)
    CAMP YOUTH LEADER (person of trust/leadership etc.)
    15 year old BOY (Jurors will think of their children)
    GAY SEX (not illegal but will irk out some Jurors)
    plus
    CONVICTED FELON

    It will be audios for him. I've said it many times, I pray he did not do this, both for him and the victim.

    This is a 2nd degree felony, as far as I know 20 years max.

    He should have taken this trial FIRST before the other conviction. That way at least he would have "never been convicted of a felony before".

    I heavily predict, 10 years if convicted.

    Worst case for Joey - IF he gets convicted 4 times for all 4 felonies he is charged with.....
    Bye bye Joey.... BYE. Period.

    That's 4 second degree felonies, on a convicted felon.
    But these aren't just "felonies" like burglary. This is rape of a child basically. Gay rape of a boy.

    We aren't talking a decade people.
    We are talking 20+ years.

    Again, wow, I really hope he didn't do it.
    I believe this state Jail conviction will shut him up like many people want, for 5 years. He'll have to do something else.

    I hope the Navarro case proves that he didn't do it. But if he really did do it, I ONLY believe he should be charged with 1 felony. I mean come on, EACH ACT during the same session is a new felony? (seriously barf).

    Sorry, I just can't see him capable of it.... The Joey I know at least....

    If its tossed - Perhaps he'll marry Presley and they'll start a family and live happily ever after. He can just start a new carrer. Hopefully all this would "grow him up".

  4. Judges & prosecutors know people all the time. So, in Jimmy's world we should all strive to make ourselves "public figures," then we can commit all the crimes we want and not be tried for them because we can always cry fowl because the judge knows of us. Jimmy, did you miss that there was a jury in this case? The judges sentence fits in with the jury's recommendation. Period.

    If Joey had such bad blood with judge Carroll that he perceived it an issue, he could have asked for a change in venue. Joey didn't. I agree with Ginger on this one. Joey wanted to go before Judge Carroll. If you know you are guilty (which Joey admitted), why not let your "arch nemesis" be your judge? Then you can just blame the judge rather than your guilt. Joey knew he was guilty. So why not go for martyr status while he is at it.

    Your arguments, Jimmy, assume that Joey has no voice in this whole thing. You assume everything is happening to Joey - just like him not refiling his paperwork for a public defender in a timely manner, or his trial being delayed. Joey isn't helpless. He is having a say in all these things by his own decisions and actions & he gets to work with his lawyer to decide how they are going to fight the charges.

    It's funny, when Joey is a bully behind a keyboard or bullhorn, his followers think he is a powerful badass capable of making change. When Joey is forced to face the consequences of breaking the law, he is this poor defenseless little puppy dog.

    Joey should have been in court a lot more frequently and faced both civil and criminal charges on several other occasions. The reason he wasn't? He preyed on two kinds of people on the blog. His little crusades usually involved people with very limited resources. They have no money to pursue Joey & they have other battles to fight first. Or, when he attacked politicians? Talk about people with bigger fish to fry. His accusations were unmerited & barely a blip on the real constituents radar. They'd just counter his claims, possibly force a retraction from Joey, and move on. Joey's words didn't matter to them so they didn't haul him into court to face the many many times he wrote libelously.

    Hey Jimmy, you asked for examples yesterday? Did you even bother to read those? People here actually take the time to write valid responses, and yet it seems like you aren't paying any attention to the answers? Am I wrong on this? Please tell me if I am.

  5. Let me clarify the sex offender "Romeo and Juliet" statutes for everybody. I actually read about them a few weeks ago because there was some confusion in another local news story.

    This is simplified.

    Sexual Assault under Texas Penal Code 22.011 defines a child as 17 and younger. There is a Romeo & Juliet defense if the individuals involved were not more than three years apart in age.
    There is also a newer law SB198 that applies to the requirement to register as a sex offender as a consequence of a criminal act if the two parties were within 4 years of each other (if the younger is 15 or older). SB198 is actually retroactive. People who were on the sex offender registry prior can petition to be taken off if there was no more than a 4 year age gap. Now, SB198 is only in regards to the registry, they can still face statutory charges if the gap is over 3 years, but they won't become a registered sex offender for consensual sex with a minor.

  6. If Joey is found not guilty in Navarro, the 5 year probation is the best thing that could ever happen to him. If it were only 2 years, he'd just wait on his life for two years and start back up. By facing 5 years, he's going to be forced to reevaluate. He can't fall back on his internet bully pulpit. If he seriously tries to obey his restrictions, he might get out and protest from the street corners, but he's going to eventually get tired of it or get busy having a real life. The perceived power of the internet was making Joey a monster. Each year since the ECO, his bullying and delusions have grown exponentially. Did you read some of the stuff that was mentioned yesterday regarding people he hurt? You should be happy for him that he is given an opportunity for a new direction in life. He desperately needs it.

    I don't think going home to Presley is a good thing for him. Sure, she doesn't judge him for his actions, but is she really going to give up her internet fight? He'd be like a junkie fresh out of rehab going back to his addict girlfriend. She'd need to start over too. If all of her anger and resentment seeps back over to Joey, he'll violate probation in a matter of weeks.

  7. the real issue he has to worry about is if the Judge stacks the sentences consecutively 10 then ten then 10 then ten i don't think its aggravated so he would do probably 12 straight and yes ohcantreader i was correct

  10. And yes, I'd place bets that his sentence will be concurrent. The multiple counts are more for appearance and effect than they are for him to serve separate time.

  13. lol If he testifies and denies the allegation and is convicted better chance that they are consecutive. If no testimony then concurrent current Navarro judge former occupation?......anyone.... Navarro prosecutor

  14. Joey would have to have a complete attitude makeover before taking the stands would be favorable. If he pulls the belligerent conspiracy crap up there, he'll be in a world of hurt. If he got up there and looked like the little kid he is, it might work in his favor. If the jury sees a broken 31 year old manchild . . . even with testimony about all his horrible acts. Talk about a head game. Even Jimmy is having trouble reconciling the multiple sides of Joey, and he knew him.

    All I want to be sure is he had a fair trial. Obviously, by what you say, he could have had a different judge or argued against this prosecutor.

    He was found guilty. Period.

  21. Ok jimmy, here is a little more background as to why this blog is here:

    For years I was a critic of Joey's over at his old ECO, in fact I am extreamly proud to be considered Joey's number one critic by Joey. My criticism of Joey both there and when I started this blog has to do with the things he did such as what he was just convicted of. Thats why most of the people on here are negative towards Joey. He spent his entire life dedicated to un-verified character assassination. That is who Joey Dauben is, and was, and thats why we have this blog and what the majority of the content is aimed at. Now the Navarro charges come out of left field. None of us have been raped by Joey and while we did know that he had gay relationships in the past and he was seemingly obsessed with sexual related content, we dont know what happened out there and thats not really where we are going with this. Now you keep talking about how you want to make sure he has a fair trial in Navarro and how you hope he didn't do it. I'm going to give you a news flash: A. At this point it doesnt matter if he did or didn't do it its what he can show a jury that matters and B. Joey is going to need much more than a fair trial I think to survive this one. Joey needs like a Jonny Cochran type, a high priced defense attorney that can convince just one juror to have doubts. I think Joey's public defender is going to do a good job and make it a fair trial, I just think its going to have to be much more than that if he wants an aquittal.

  23. Jimmy, he may or may not have been able to have gotten a change of venue, but the question could have been raised before trial, yes. It wasn't raised, so Joey's camp either didn't think it was a big enough issue, or Joey actually wanted to fight it out in Ellis County.

  24. I've known Joey for a decade. Mostly 9-10 years ago is when I mainly had contact with him a lot. This was when he was at the Ellis County Press doing the paper. I liked his fight against taxation and government corruption etc. He even published several of my articles. I really have not known him well even in that period on a personal level... I have only seen him on and off in between 3-8 years ago when going against taxes being raised. I have not seen him in the past 2 to 2.5 years at all. I've gotten his emails about taxation issues, some on some corruption issues, but have not spoken with him for that time. I did not know him to make horrible statements against people.

    I did not know he lived with his grandma, his family, or any of that sort.

    I do believe at one point I thought his parent's house was searched because of him but I dunno, I have no details on that and I think I heard that from somebody.

    I thought he worked at some kind of printer in Arlington (like a sign printer or something), along with some kind of ad revenue business on a web site. Plus on the side I thought he bought & sold domain names.

    I didn't read his ECO site or any of that.

    And just to clarify, yes, gay sex makes me sick to my guts. But an assault on a minor thing embedded with gay sex makes me want to puke my guts out.

    A 26 year old man going after a 15 year old GIRL would just make me want to hurt the man.
    A 26 year old man going after a 15 year old BOY just makes me want to vomit.

    Guess its a double standard, but equally horrific to a minor.

    I'm all about fair trials, low taxes, and constitutional government. That's the basis of how I met Joey.

    That's why when I read all this stuff about "daddy's worm", and gay sex at church camp, and going after Amber Haggerman's family (etc. etc. ETC.) or whatever is like -----..... WHAT?? ..... Seriously it's like unlocking the doors of the twilight zone.

    Heh, yeah, he was working by signing up thousands of domain names that sounded almost exactly to a major site like microsof.com. When a poor unsuspecting person types that into their search engine they are taken to a site that kinda sounds like what they were looking for but isnt' and is looking to sell them something. Every time someone is tricked into that site, joey gets paid and an angel loses it wings. This scam of Joey's ended with him being successfully sued for between $700,000-$1.2M in damages by these companies he was defrauding.

  26. Jimmy, I think it's really hard to speculate on the upcoming trial. They've been very tight-lipped about what the evidence against Joey is. We know there is an accuser. We don't actually know how the accusations even came to light . . . like if emails or texts were found during one of the searches & they went to the boy . . or if the boy came forward with the charges himself. We know there is some sort of email/myspace interaction between the two after the fact. That's about it. Anything else we know Ginger?

    If Joey admitted/discussed their sexual relationship in the online interaction, that could be the heart of the case. If he didn't, then obviously there is a lot more that we don't know. This thing isn't going to get to trial 5 years later without pretty damning evidence. Right now, Joey is innocent until proven guilty. So, I'm going to entertain the possibilities of what his life might become if he isn't found guilty. But, I'd bet Joey has a pretty good idea what they have on him & if he is going to prison for it or not. This goes back to Joey having choices. Think about the choices and actions he's taken in the last year with regards to waiting so long to raise question about his representation request or his pretty blatant use of the internet. . . maybe he did those things because he already knew he was going to prison.

  27. Well from what Brandy said, right before she went dark and right after leaving the ellis county press group....
    the incidents in question happened at a bathroom and out on the boat. There are witnesses that are going to be able to testify that joey and this boy were alone together on the boat and in the bathroom in question. Also, there is going to be instant messages between the boy and joey after this incident that would indicate at the very least, a strong bond between the two. There is probably more than that, but thats a little preview. And so far from team Joey the defense we have heard is this kid is from a foster home so that makes him a liar.

  28. and then you throw in the fact that the texas rangers investigated this and a grand jury signed off on it, plus looking at how utterly inept Joey was in defending himself in Ellis County, I dont see how he has a snowballs chance in hell of getting out of this one
