Joey Dauben Sentenced to 5 Years Probation, Sent to Navarro Jail

Wow, it turns out that the Ellis County conviction does have some major teeth to them. Joey can not use the net except for online banking, employment or bill pay. He can only have one email, he can't post anything anywhere. He must use tracking devices on all his electronics. He must delete all his blogs and social networking sites. He has to pass a polygraph each year. Basically his entire lifes "work" will be erased and only sites like mine and news stories like the Daily Light will be all people can ever read or see of Joey. His probation will kick in after any sentence he gets in Navarro, and speaking of that, Presley can put the strap-on back inside the drawer because he is not out of jail but being transferred to Navarro and will sit there with a $100,000 bond.

What this all means is we will never hear or see of Joey Dauben again. In a personal way, I'm kinda sad about that because he provided me with endless hours of laughs I couldn't possible find on TV. But on the bright side, he has slandered his last soul as he now becomes an internet ghost.

  1. I think David is the one that's delighting in this news the most.
While Joey G Dauben was transferred today to Navarro, possibly facing 10 to 25 +++ years in prison, what's the first thing his daddy does? What's on this fathers' mind? He logs onto his facebook and posts this:

It simply astounds me at the lack of brain cells in that man. Joey needed attention desperately. He reminds me of some toddlers who would behave negatively because that's the only way they can get their parents attention. What we have is a 31 yr old toddler tossing his toy trucks at the dog and throwing himself on the floor yelling and screaming in his wildest temper tantrums. Unfortunately, because of his age, there's much worse consequences behind bars for tantrums than being placed in a corner on a timeout.

David, seriously. WTF is wrong with you!!

  2. So the jury decision did hold? Carroll changed it? How does that work?

  3. Nothing says 'CELEBRATION' like posting a yeehaw poppa-wheelie picture on possibly the WORST day of his son's NEW life. I'm sure David is happy he can now buy more DEEEcals and spray paint for his real baby. Frick.

  4. I was confused about that as well but it turns out that the probation lenght was up to Carroll as well. I had to go back an re-read the orignal article to figure it out

  6. You have to ask the question, why does Cheri stay with him at this point? Just one actual reason? She made the second biggest mistake in her life when she decided against divorcing him (first of course was marrying him in the first place) but why stick it out now? His money? His intelligence? His blazer?

  7. where is Mr/Ms Just the Fact to tell you that wording is wrong (when it really isn't)?

Soooo, within 30 days release from confinement he's gotta basically erase his internet presence . . . what if he never is released? Does it just sit there?

  8. Just another article to toss in this mix.

Apparently Presley is EXCITED to be pregnant in the near future. This from Mrs Yahweh who posted a month back on FB to a friend that she wasn't dating him at the moment. Excellent well thought out life decisions Chubby Checkers.

"Dauben, who was returned to jail because he will soon be transferred to Navarro County where he faces criminal prosecution on charges he engaged in sex with a 15-year-old male teenager on a church trip five years ago, was disappointed by the conviction but he and his support network of family and friends remain upbeat, according to his girlfriend Presley Renae Crowe.

"Joey is confident, and he knows what he has got to do," Crowe said in a phone text. "He's ready to at least get all of this behind us, and get our life going so that maybe one day we can start a family. That idea and the thought of being with his family with no restriction is what is keeping him going."

  9. Poor Presley, she is looking for an excuse to explain her rapid weight gain.

On another note, does she not have even the slightest clue how bad it looks for her to be intimately connected with someone who is about to stand trial for raping a young boy, when she is trying to wage some kind of crusade against pedophiles?

  10. I will tell you what's in store for Joey while he rots in a jail cell or prison.... But will wait till after the next trial. No, no violence, talk of anal sex with bubba the big bad inmate, etc., but how to help those make right what he has wronged, while he is powerless to do anything about it. It's time to make right what all has been done wrong by Joey Dauben and the Ellis County Observer.

The next chapter is his trial.....

  11. The only thing that rings in my head is good ole grandma's words. The lights are on but nobody's home.

Isn't the 'no restrictions' word an interesting insight into Joey's world? He just wants to come home with nobody telling him what to do. He will never get it.

@LOL below.... Great compilation. I wonder if we should all start sending Joey crayons one by one. Let him start off slow.

If anyone has a good picture of Patrick Wilson and Bob Carroll, I would like it! Working on a new YouTube video for lil ol Joey! Need those 2 photos to add to the cast of characters!

  14. Joey thinks he has lost his freedom for now... It's longer than that.

Look for other non prison / non criminal related developments once the Navarro case is disposed of. Once the rat is in his cage, the rest of the work can begin.

While we are on the subject of Joey, I bet he starts writing his appeals to the 10th Court of Appeals, if he hasnt started already. I bet he tries to get his law degree from the Todd Phillippi School of Jailhouse Lawyers. After all, 2 of his lawyer and ex lawyer friends are convicted of crimes ranging from Class A Misdmeanors (Rodney Ramsey for the evidence deal when he was a cop) and then Todd Phillippi for fraud.

  16. Hey does anyone have the Ennis Daily News article that is online now? It is a pay site.

Interesting quote from the part I can see- describes Joey during deliberations and then during the verdict!
    http://www.ennisdailynews.com/news/former-blogger-guilty/

"Dauben stood motionless as the judge read the jury’s verdict, and joked with his friends while waiting for the jury to deliberate his sentence."

I bet he isn't joking now. He didn't think Patrick Wilson would take him down. I bet R. Lowell Thompson does more than that! The trial this week was just a "love tap". The next one should be a grand slam.

  18. Too friggin funny.

We saw the cast of characters in this trial.

Wonder how the sequel will be? Will he take a plea deal to save his arse? Will he fight 'till the bitter end? I was expecting this trial to be the sequel, not the original pilot episode! I was not much amused with the thought of the "fanfare" for this charge. I figured it would be a "dud". Guess I was wrong there. This was priceless. Wait till he gets through a week or two long trial and gets a prison sentence.

Sorry Pressley, they don't allow congential visits in the Texas prison system. Not that Joey likes women anyway.

I always found it odd how he associated himself with young adolensents while in his mid 20s... Like high school age kids. There was a deal at Ferris HS one time that I can't seem to recall involving him and a HS student.. Been too many years ago.

You know, up until now I've appreciated David Webb's articles. His affection for Joey was apparent but his reporting was objective. I have several issues with this article. Mr. Webb seems to have been drinking too much of the Joey Kool-aide since the last time we heard from him.

Of particular irritation is this statement "Two years ago Dauben received a $10,000 settlement in connection with his false arrest in 2009 by Combine police officers in connection with his posting of a mug shot of a policeman".

A more appropriate statement would be something like "Joey sued the City of Combine for false arrest and the suit was settled for $10,000". Joey wasn't falsely arrested. The crime was real and the charges were viable. For whatever reason the charges were dropped. That does not mean the police made a mistake in charging and arresting Joey.

The settlement amount screams nuisance value to me. In the first place, if I had been falsely arrested and kept in jail for 9 days, I'd want a lot more than $10,000 for violation of my civil rights. Secondly, the suit was handled by the City's insurance company or the City's attorney; the cost and time of defending the suit would have been weighed against the settlement demand and whether the amount could be negotiated to agreement to settle out of court. Whether the city was right or wrong in arresting Joey is irrelevant. Cost is relevant. If it would cost $20,000 to defend the suit in court, Joey's attorney was demanding $15,000 but would settle for $10,000, the insurance company or city would pay the $10,000 to make it all go away. The lower number wins, nuisance value = $10,000.

If Joey's attorney had demanded, say, $500,000 and refused to negotiate, the suit would have gone to court. In this case, Joey's attorney would risk a take nothing judgement in favor of the City. As Joey had no money, the attorney was working on contingency. If the suit was tried and Joey lost, the attorney would make nothing for all his hard work. The demand was low enough to ensure a settlement out of court so that the attorney would be paid. As I recall, Joey's attorney took $4,000 of the $10,000 settlement.

Sorry to get off on that. It just makes my head almost explode every time I read something that implies Joey was falsely arrested, sued the city and won. He didn't win, they paid him to go away.

  20. I don't know about his association with adolescents but I think Presley is only 18. Maybe Ginger is right, he's 'try' sexual. He'll try anything because he's SOOOO desperate for attention, he'll turn to anyone or anything to give him that. EVEN negative attention, I think he quietly loves that this blog actually continues on to yap about him for months on end. Something is better than nothing.

At some point the best thing we all could do for Joey's victims is to stop feeding the beast. He should be forgotten, alone in a jail cell to contemplate all his wrongdoings. If I have him pegged right, he won't ever do it though. Cheri and dddd-david hard-wired that kids brain to avoid all responsibility for his actions even WHEN he outright admits he was wrong AND fully willing at the time (of the apology letter to XXXXXX) that he will take legal responsibility. BUT when push comes to shove, he bails and cries FOUL! Poor Joey, Joey didn't do nuthin!! Harmless, accidents is all. That is until some very angry disturbed sexually abused adult who has nothing to lose reads crap like this and kills someone like XXXXX.

Even then, Joey and his parents would still scream it's the disturbed persons fault, NOT JOEY! he's only the messenger.

I wish Brannon would have shaken this little freak awake instead of hearing how he giggled it up with Joey in the courtroom. Its no joke, your buddy's life is OVER. Be a real friend and tell him to suck a plea deal and save a small portion of his 'youthful' life before its too late. Yahweh WILL NOT be striking any courtroom. Time to wake up, the game is done.

David, you're a freaking ass. How could you even fathom getting on FB today? I don't care if its for 4 seconds, your SONS LIFE is over.

But hell, play ostrich. Your head can stick in the sand all you want and play a scamming wannabee poppa wheelie, Imma get my own version of 'moonshine' reality TV show, uhh huh, you watch, it's gonna happen.

The fact you were scammed by Farris and now follow Billy as if he's the new God of the day shows you have no clue how to really deal with life. If you were actually a GOOD father, that man would tell his son to admit to his actions no matter how bad the consequences. JUDGES ACTUALLY appreciate when people come forward and say "yup, I DID "a, b and c" your honor and be damned if I'm going to ever do that again. i will do anything and everything it takes to turn my life around and make amends. I cannot take back what I did but from hereon in, I CAN be accountable for my actions and choices. I realize you're going to give me some hard time because of the laws of the land and as a strong proud man, I will take all you dish out like a man. Then I'm going to prove to you, my family and the 'world' how sorry I am and make those changes so I can have a life."

Judge would give him 1/2 the amount of time. David is NOT going to tell his son to cop a plea. He'll placate that little freakshow to the very end telling him how bad and evil the world and gov't is and how daddy is doing all he can with his limited resources (brain mass included) even painting up the Wheelie JOEY. You watch son, Billy will get you out.

In the meantime, Billy says jack squat tonight or any other time about JOEY or his conviction. The only tiny mention from Billy was that he 'visited' SOMEONE in an Ellis county jail but it was personal, not an interview.

David, times up. YOU have this 1 chance to be the father you never were. Kick that little brats ass and force him to own his lifes choices mistakes and all. There's no Billy Lawless to save the day. Can't you see even he washed his hands of you and Joey? He doesn't give a crap if you painted up your wheelie with his logo. There's no hero coming to save your family. Its in your hands.

    Cheri? ??????

  21. You are right. He was paid to go away. His suit was for 500k. Rodney Ramsey represented Joey.. They made an initial offer of 10k to TML and TML took it. It would have costed more than that to defend the suit.

  22. nothingbettertodotodayNovember 16, 2012 at 1:48 AM

Thx - I couldn't remember if it was Ramsey or Griffith that rep'd Joey. A demand of $500k would be reasonable if allegations were valid. I hope the City countered with $5k first, $10k was too much (in my busines $5k is the bottom end of the range for a nuisance suit). Either way, Ramsey got $4k, for what, about 1/2 day's work althogether - drawing up papers and a few phone calls. Which is 40%, a higher percentage than most attorney's take of the settlement. Ramsey played this one perfectly.

  23. Yeah you are right about the judges being lenient thing. I know Bob personally, and I know he would have been overly light on Joey had Joey admitted his wrong taken responsibility and demonstrated a true desire to change. He would have given him less than even the plea offer. Instead, joey went down defiantly. Afterall, he has already written his end so he might as well play out the final chapter, even if no one cares any more.

I was talking to somebody last night that thinks Wilson's support of probation and Carroll's sentence are part of a master plan. The theory is that both know Joey can't go 5 years without a violation and so will end serving his sentence in jail. Just food for thought. I think it's more likely Wilson argued in favor of probabtion to show he's not holding a grudge for what Joey posted about him and Carroll applied the max because Joey didn't repent.

    ReplyDelete
  25. I think the punishment is really good. To have the slightest potential for effect, it needed to be long. Say Joey is acquitted in Navarro. We all think he got a fair trial in both cases, & he's left with just this crime. Well, Judge Carroll wants Joey to become a mature productive member of society. If by the end of his other trial he's grown up just a bit, hopefully he will not try to circumvent his punishment. (He'll probably have to remove Presley from his life because I can't see her cooling it on the web for Joey's sake.) If Joey only had 1-2 years of probation, he'd just consider it a time out and go right back to it. If (by some miracle of Yahweh), he stays off for his 5 years, he might just have a chance at learning to be an adult. I know it's a stretch, but the court has put the ball in Joey's court. There are so many changes in Joey's head & the people around him to make it work, but I think this is the only way he has a reasonable chance of turning his life around. If Joey isn't guilty in Navarro, I really hope he will find a way to obey his probation and move on.

  26. Maybe it's Cheri's momma nature. She knows that David would be in a homeless shelter if it weren't for her. There is no way he can survive on his own. Perhaps she feels guilty that she's been his crutch all these years.

  27. nothingbettertodotodayNovember 16, 2012 at 11:13 AM

I had the same type thought. Whether intentional or not, Wilson and Carroll did Joey a huge favor and stepped in like parents of a naughty child. One or two years isn't long enough to change the pattern. Five years may not be long enough given his "support" system. But at least Joey was given the opportunity and freedom to chose to change his life.

I doubt that Joey ever really plans to marry Presley. It's all window dressing. She'll end up back in CA, just a matter of time. If Joey is convicted in Navarro's trial and goes to prison, she'll leave sooner. WIthout Joey in day to day life she has no future here. She's 18? I just can't see any 18 year old hanging on to a pipe dream for 10 years.

But, just in case I'm all wrong, hedging my bets..........where is that petition for forced sterilization????

Thanks for the correction. Even at 20 she's still too young, she won't wait for Joey to get out of prison. That bio clock will start ticking, she'll meet other people and move on. If Joey doesn't go to prison, she won't last longer than 2 years.
