According to Brannon, it only took one day for Patrick Wilson and a jury to bring down the hammer on Joey in the Ellis County case. Brannon said its 2 years community supervision, up to a year in jail, and $2,400 fine which will take the Dauben's at least 5 years to come up with that kind of money.
Joey made a fundamental mistake in underestimating Patrick Wilson. The Daubenistas took Patrick as a dolt and figured he wouldn’t never pull this thing off. Joey could have taken a plea that would have kept him out of jail, but his arrogance costs him dearly once again. Now Joey gets to join the infamous group of people who are called convicted felons. Next up we have the list of those called registered sex offenders.
So he got probation ? Then he is out of jail right now?

I would think what Brannon was saying is he has up to a year in jail in addition to the probation, so its up to Carroll tommorow to decide how much he serves.
ReplyDeleteThe way I read the article and Brannon's update is that he got a $2400.00 fine, one year jail time probated for two years. IOW, he will be on probation for two years with one year of jail time hanging over his head. So any pool started should run twenty-four months. :) It will be interesting to see what the conditions of probation are. My guess: No publishing, print or internet. No blogging. So short times in the pool would probably be the winner.

ReplyDeleteor, I guess the new question is, if you get two years probation and then shortly after that get say a 10 year jail sentence for an unrelated matter, does the two years probation kick in after you get out?
ReplyDeleteThat's what I read from your link. A couple curios things did B or Shane testify? I looked up state jail felonies and it said the max was two years not five anyone know that one? Also Wilson asked for the max but only got the bare minimum of two years probation? These are just questions without an agenda
ReplyDeleteI think Brandy is on deck to testify in the Navarro case and didn't testify in this one. Sounds like only two people testified and he didn't use Shane. He ended up playing it safe and getting the conviction but only half the sentence. Again though, I think its about the be irrelevant as soon as the Navarro case starts.

ReplyDeleteSo Brannon, are you able to knock any sense in to Joeys head and tell him to shut the flick up so he can maintain a tiny bit of freedom until Navarro? The only friends I have in my life are the ones I can be completely straight with. Sometimes I'm called nasty names but I have thick skin and they love me for telling them what they need to hear, not what they 'want' to hear. I don't bother with those who want to be placated or babied or lead into a false belief that everything will be 'just fine' in life if you continue down the path your going. In turn, those friends do the very same for me. I may swear, cuss, yell and scream or toss a temper tantrum for a few minutes at the audacity of their 'meanness' but if they didn't love me, they wouldn't tell it like it is.
ReplyDeleteLifes to short to dick around. What future does joey have? getting out of jail at age??? 43/ 45/ 48 with no ability, job skills, employment history or educational history. Will you continue to feed him, house him, let his chaos invade your world? By then you may have a wife (or 3;) ), kids, mortgage, maybe you'll even be the owner of that awesome monument THE BEER CAN HOUSE too and give us all tours and demos. (AND free product)
Where does joey's life go from here? You can learn from your mistakes and make changes OR you can remain the same thus history is bound to repeat itself.
You can laugh and joke with Joey, have a good time and chuckle about the past while it lasts or you can make a lifetime impression on him. Its still up to him to choose to take the advice or not but really Brannon, I believe if anyone has influence in Joey's life, you're about the only one who does.
yeah its going to have to be Brannon, it sure wont be Daddy Dauben or Presley. I hear Presley is already tring to pitch TLC on a new reality series called "Fianced to a Felony"

I remember being about 17 or 18 when I first saw this on TV. thought it was about the most amazing thing that someone ever built. I may have had 4 or 6 or 12 too many Bud's at the time, who knows. It took me 20 years before I could visit in person, but was worth it.
I know no one really gives a rats ass about anything I type but I need to live up to my screen name. Since Joey's Navarro trial is a couple months away, maybe Funday's pics can come back during the Thanksgiving and Christmas season to tie us over. Can't y'all picture Brannon in this?

Talk about irony. Convicted by Patrick Wilson after being warned by Rodney Pat (who pled out to a misdemeanor instead of a felony) himself- to back off. I wonder how this will effect Dauben's relationship with Todd Convict Phillippi. Know he cant associate with another felon and all, but maybe Todd can share some tips on how to survive on the inside!
If I understand Texas law correctly, and in this area I may not, if you are subsequently convicted of a felony for which prison time is assessed then your existing sentence runs concurrently with it. I could be wrong but that is my understanding. Kind of irrelevant anyway. If Joey is convicted in the Navarro County case I expect at least fifteen or twenty years (anything over fifteen can't be probated) of which he will have to do ten to twelve calendar years and then parole for the remainder.
