Dauben's Clan Can't Understand Why Shane Crowe is Here to Testify: ItsCalled Cyberbullying

Daddy "I don't understand" Dauben and Presley "I love pedophiles" Tunafish are outraged that Shane is coming down here to testify in Joey's Ellis county case. Since both operate at a kindergarten level, we will try and hash this out for you.

Patrick Wilson just showed exactly why Shane is here in his question to potential jury members..."Do you know what cyberbullying is?"
Joey Dauben is a cyber bully, and thats not a debatable point. He was one when he went after this guy in Red Oak, and he continued that well after when he went after Shane. The Daubenistas won't understand what I'm talking about since they are sure that Shane is guilty of what Joey accused him of. But for the rest of us on planet earth, Shane has not been convicted of and therefore is to be presumed innocent of those crimes.....PERIOD. It doesn't matter what you believe, it only matters what you can prove. And so, when Joey went after Shane in the exact same fashion that he did against this guy in Red Oak, he established a pattern. Shane is here to not only show the jury members that Joey didn't learn his lesson, but that he has only become more violent and offensive in his cyber bullying.

  1. I'm sure the D.A. is a lot smarter than I am but I probably would have avoided Shane as a witness, not because I don't believe he is innocent but it just seems to open a can of worms. But then I got to thinking. Calling Shane to the stand means that Presley will beat the defense attorney over the head until he puts her on the stand to save his life and sanity. And her testifying will guarantee a guilty verdict and long sentence. Mr. D.A., I salute you.

  2. yeah I think Patrick has already played this all the way through. The last place on earth Presley wants to be is on the stand under oath trying to defend all her different postions she has taken. Then you get to tie into all this that Joey and Presley had a relationship as a result of his cyber bullying. You are right, this could backfire, but that would be dependant on Presley being on top of things and she most certianly is not. I think Patrick will have those jury members foaming at the mouth to get back there and convict Joey.

    At first I was little worried that Wilson might not know how deep the doo-doo is in this pile and Shane vs Presley would derail the issues. After a little thought, I decided Wilson probably fully understands and will use some of the doo-doo to his advantage. I saw him do this in an abuse trial He was extremely effective and the doo-doo pile was much higher and very, very dark.

    After a little more thought, I think I'd like to hear rebuttal to Shane's testimony. If Presley is called, Wilson may give her the spanking she needs. Sad thing is, that if Wilson does slap her upside the head with the truth, she doesn't have the capacity to reflect and learn from it. The Daubens would use that to solidify her believe that the entire judicial system is corrupt and the government was successful in their conspiracy to shut Joey down, at her expense.

  8. What it tells me is Patrick is after the max conviction, whatever that is. He could play it safe and ignore all these side show issues and just go with the case at hand, he would probably get something but nothing with the teeth he is after. Patrick Wilson isn't going to go into a courtroom against Joey just to slap his hand, he wants blood and he is willing to take risks to get it.

  9. And, keep in mind, this case can only go so far into the Shane vs. Presley drama, its only going to go as far as Carroll will let it. I think the simple point that Patrick wants to make is that Joey continued to do the same kind of behavior he is on trial for well after that. No matter what you believe about Shane he has not been convicted in a court of law of molesting his kids, so to call him a pedophile online and in print is a crime. It really doesn't have to go any deeper than that.

    I think Wilson is skilled enough to keep it from becoming it's own event if he's prepared. If he's prepared, he will eat Presley alive on the stand. He's not going to show any sympathy, he will challenge her "side" in such a way that she'll walk out of the court room believing there's not a more horrid, evil man on the planet.

    I was wondering if more charges haven't been added. Didn't I read somewhere that Shane was in contact with Wilson to file a complaint?

  11. Well I'm thinking Patrick probably realizes what a loose cannon Presley is with all her antics from out west, tough talk and all. If he's seen a spig of her online FB antics, he understands he's dealing with someone that is missing a few bricks from the pile. All of her emotion and rage is bound to spill out and maybe he's hoping she'll scream all kinds of conspiracy crap straight from the Dauben camp. My bet is that's what he expects to happen. Then he may give her some rope asking her to provide concrete evidence to her abuse claims. Since this apparently has all be investigated many times and by what I've read online even the FBI has polygraphed her father and cleared him. She has nothing but her rage and emotion. While she may feel and believe she's a victim of abuse, in a court of law the only standard is evidence. With what Joey wrote about Shane and the semen in the diaper, that info was either straight from Presley without any credence or Joey just made it up to enrage his fellow readers. That too can or will come into question and without any evidence, it shows Joey will write whatever he feels like WITHOUT any backing of evidence or proof from law enforcement or a court of law.

    In the end, Joey MAY have been motivated by 'little joey' and had the hots for Presley willing to say and do whatever she wanted so King Yahweh could welcome his queen into the kingdom.

    Even though I've spilled my opinion on how this may play out knowing Presley is reading word for word, I'll bet everything I own, she is so out of control, she will not be able to control her emotions. She's too far gone. She was even spewing today how Alex Jones media said 34 states are going to Secede and she believes that already happened. Hellllooo Bueller?

  17. I think they already put her in jail, plus they want to nail Joey I don't think anyone would deny that. That doesn’t mean its a conspiracy, it just means Joey is an annoying little prick they want to shut up.

    Again, we keep thinking of this trial as a case of whodunit type of thing, did he or did he not do what he is accused of? Well that is the case in the Navarro charges but not here. Joey is guilty as sin of what he is being accused of. He even admits that. The only question is the penalty. If this were Joe Schmo who runs his own blog that covers this and that. One day, out the blue this girl Kristin comes to him with these documents and outrageous allegations against her ex, he gets caught up in it and lashes out at her ex online in a brief fit of rage. He then finds out that what he said was not true, apologizes profusely and never does that again. Now, Joe Schmo, like Joey, is guilty. But a jury is going to feel sympathy for Joe and will chalk it up as a one time honest mistake with good intentions. But this trial is about Joey Dauben, and Patrick Wilson is going to drive home the point that what Joey did, he did all the time and continued to do it afterwards. He did not learn his lesson, it wasn't an honest mistake, and if he is not punished, he most surely will re-offend. That is why Wilson is doing this, its way past did he or did he not do it.

If somebody mouthed off like Joey is accused of, somebody kicked his butt and the situation was over. Now today, everybody is telling and filling our court systems with this bologna.

    The only thing I'm concerned about is that TRUE molesters be locked up. He said - she said junk, Cyberbullying (which is not even a crime) and all this rumormongering is just nuts.

  33. While I sort of agree with the first sentence - in that there are way too many litigious people wasting our court resources, this goes deeper than that. This is a criminal offense. If it were a one time deal & Joey issued a sincere apology, perhaps it would have been dropped. Since Joey continues to bully & harass people, it deserves to be heard by a jury. He actually hurts people. If you search his ECO 2 site (which has probably 1/2 of what was on the real site), you'll find SEVERAL half-assed apologies. Joey didn't take this as a learning tool to be a respectable journalist who checks sources before printing libel. They may only be charging him with the identifying information, but the whole thing goes deeper than that. Think of it like doctor malpractice. A doctor makes a mistake that causes somebody injury, malpractice pays damages & everybody moves on. A doctor does it over and over and over by being negligent & you can prove that he knew what he was doing or covered his mistakes further harming patients, the doctor should face charges.

    All states have laws that address cyberbullying/cyberharassing. By bringing up cyberbullying, they are establishing a pattern with Joey. He neglects the rights of other people. He posted things to get readers. There was no due diligence.

    Lots of people come before the same judges multiple times. While it's possible a judge may be biased. If I were a teacher or principle of a school, the same student might come to me several times for some sort of decision of punishment. Just because I make a judgement in one instance doesn't make me automatically biased and unfit to decide in another instance. The judge should be interested in justice for all parties as defined by the law.

  38. So Joey indicates that he's published documents supplied to him before & gotten in trouble. He's made threats before and had to answer. Yeah, so both cases were essentially dropped, but he knew the potential consequences he was opening himself up for. If he's truly doing valuable work, wouldn't he do better to make a couple simple changes in the way he is doing things? I mean, if he's in jail, he can't be helping people, right? Seems simple to me. But no, Joey goes on posting things without thoroughly vetting the sources or their documents. He pretends to apologize, but it's full of excuses and qualifiers. He continues to threaten people, but he makes sure to put in his key word, "if." Does that really make it OK? He supposedly has so many readers. Wouldn't his words be a call to action for them? When you publish that somebody is a child molester aren't you putting their lives in danger? Joey takes no accountability for his hate mongering.

  39. I don't think he was targeting the women for sex as much as the appearance of it. On some level, Joey is aware of his immaturity and lack of masculinity. He goes over the top in trying to prove that he is a man (with man wants and desires). Joey is social awkward at best. I think if Presley or Connie came to him and said they'd pretend to date him but were completely abstinent from all physical interaction, he'd have jumped on that deal in a heartbeat. I think it's more about saying, "I can have this because I'm a MAN."

    @ Jimmy S: I can see that you have not completed your ECO reading assignment. You said "mouthed off like Joey is accused of". This is not an allegation or an accusation and not rumor mongering. It is a well known supportable fact that Joey mouthed off with malice.

    Read the search warrant and pay particular attention to the probable cause explanations. The whole thing has been available on line since early this year, Yappy and OReader reposted it earlier this week on this blog. It states "The postings further included indirect threats and enticement and/or soliciation of unknown person(s) to commit physical harm, up to and including murder, against the victim and/or his family." This behavior is against the law, as is "kicking Joey's butt". As OReader points out, Joey did this over and over again.

    It's the DA's job to fill up the court system with people that break the law. Joey broke the law. If somebody decided to "kick Joey's butt" because he posted lies, personal information and incited violence, that somebody would be violating a law. Do you think Joey would not file an assault complaint? Should the DA not prosecute an assault on Joey to avoid filling up the courts?

    If Joey had targeted you because he thought your ex was hot or because he doesn't like your chosen occupation and continually posted lies about you, told the world you should lose your job, told the world you molested your children or called out for some one to physically harm, I'd bet you'd know all about the cyber-bullying laws and want the court filled up with this junk.

  45. so, first off, The DA only had 2 witnesses come up, and pretty much by noon it was done, then They gave closing arguements, then The jury went in and came back out declared him Guilty, Actually Wilson was the one that urged for The Supervision or (probation) but for the Jury to allow them the max in case he violates it, so The jury said I'm pretty sure 2 years probation and then 1 year max state jailtime, and I'm guessing tommorrow is to figure out the what he can and can not do for the probation and for the judge to make it official so it started around 10 or so and ended around 5. the Jury part though is done with

    This is the most interesting question to me...he refused a plea deal so clearly he thought he could get a better outcome in a jury of his peers (how did they find 12 unemployed, self-loathing mongoloids?). Further, what defense is there to just plain stupid?
