Thanks to "lol" for giving the heads up on this http://www.10thcoa.courts.state.tx.us/opinions/pdfOpinion.asp?OpinionID=11327
This is Joey Dauben trying to contend that he is indigent in his civil case against the state for seizing the ECO. He claims he is indigent because he has a bank account of negative 11 cents, no stocks, bonds or savings. He claims he owes $20,000 in student loans, $5,000 in medical bills, and $2,000 to the ford motor company but in true Dauben style he can't provide one shred of documentation to back that up. He also says that none of the creditors have tried to collect on those debts. He fails to disclose the current car that he is driving as his. Anyway, bottom line is the stupid kid can't even get up there and prove he is indigent, so he has to pay the court costs and that's why he dropped the case.
Some on here wonder why we keep going after his parents, and the evidence from this shows exactly why. David and Cheri Dauben both are actively subsiding Joey and his lifestyle. They admit they are paying for everything for Joey even though they also admit he is more than capable of seeking employment. This isn't just "we are supporting and standing behind our son", this is we are going to continue to financially enable Joey so that he doesn't have to get a real job or enter the real world. They are both terrible parents in just about every category and still to this day they are repeating and doubling down on their mistakes. Joey also fails to mention the massive judgements against him in his civil cases.
A good Question is this suppose he does not get convicted on these charges. Is set free.Who will pay his bills and change his Diaper and give hime his passy when they both are dead.Kimberly and Shelly his supportive sisters.Something they should prepare themselves for as well as their husbands.Maybe a cottage out in the backyard.Remember he will need his Lazyboy chair a laptop, flipphone for the radio show and putting things on youtube and a good supply of Samuel Adams Beer for those all nighters to meet the next deadline!!Something worth while thinking about for both Sisters to think about now!!
ReplyDeleteMy favorite part is:
ReplyDeleteI glean from your testimony that you’ve been working actively
full-time or part-time in connection with one or more of the 50
newspapers. According to your testimony[,] your cash income from the
newspapers is zero. And your account receivable, that is your
uncollected cash, is less than a hundred dollars.
MR. DAUBEN: Yes.
THE COURT: My question is, did it ever occur to you that maybe it’s time to go out
and to try to apply for a different job?
MR. DAUBEN: It occurred to me, but I’m not going to give up doing what I’m doing.
yeah I know, its pretty classic. I can't really add anything to that to have fun with it, the facts alone are all you can say.
ReplyDeleteOh come on Ginger, there is always something fun to add.
ReplyDeleteI found photo evidence of the indigence:

Roflmao!
ReplyDeleteSpeaking of Ford... Didnt he buy that car from his buddy Matt Murrey the Ellis County Deputy/ car salesman? Guess it got repo'd.
ReplyDeleteWonder if Murrey visits him in the clank?
Anyone thought about getting and publishing his visitors lists and call logs?
lmao Funday.
ReplyDeleteaah gee nuttin to add except if Joey is out of touch with reality as much as his Dixie Chicks Pres n Connie, he's on his knees right now prayer for Yahoo's lightnin'.
Yeah yappy, I have a feeling Joey will never give up on the ECO

And, luckily, Joey's family is ALWAYS by his side.

ReplyDeleteI forgot a couple of things on the last photo of the new ECO headquarters . . .
Although I am in general agreement with the sentiment posted here the headline for this entry has a basic error in it. Although Joey would be required to prove, by a preponderance of the evidence, that he was indigent to get the filing fees waived in a civil case, he is under no obligation to prove his innocence in the criminal matter. The presumption of innocence requires the State of Texas to prove, beyond a reasonable doubt, that he is guilty of the crime of which he is accused. (BTW, presumption of innocence is only applicable to the court setting, the judge and/or jury must give this presumption, which can be overcome by testimony/evidence, to the accused. It does not require that anyone else, the public, press, authorities, etc., presume he is innocent....only the court). The burden of proof is on the prosecution to overcome this presumption.
ReplyDeletePersonally, I believe he is guilty as sin and expect a jury to find the same way....but I believed that of O.J. also.
yeah you are right in the technical sense. I just find it so funny that poor Joey who has negative 11 cents to his name, can't even show proof of his own indigence in a court of law, how in the world is he going to overcome the texas rangers?
ReplyDeleteSo, I screencapped a couple of quick images off a Joey YouTube video. His notes looks exactly like I'd expect them to look. You should be able to read nearly everything, so I won't spoil your fun by writing what they contain here.

That's right, wind. Right off the bat, I have a better track record that Connie the professional Bible Code Lady. See Connie, Yahweh doesn't like your man of lawlessness. He's just another conman like you.
OMG, that could be used in his insanity defence. His only hope next week is to claim he is, and has been, mentally insane thanks to his upbringing. He has ample proof to back that up. The funny farm is a lot better than staying at the pokey.
ReplyDeleteHe could claim he has PTSD and as a result, sees porn rings everywhere. JK
ReplyDeleteI feel bad for everybody involved in the court case. Joey may not fit the definition of insane or incompetent, but he's definitely troubled and holds some really irrational beliefs. Just because he can still function day to day and knows right from wrong doesn't make him right in the head. Yes, I think he's guilty. No, I don't think he'll come up with a viable defense. Yes, I think he should be locked away from the general population. His actions hurt people. But, above all, the kid needs help. If my tax dollars get him the help he desperately needs, I'm OK with that. I won't be holding my breath though.
I love how counterintuitive this is:
ReplyDeleteGET OUT OF JURY DUTY ANYWHERE IN AMERICA FOR ONLY $17.
Just send $17 plus $2 for shipping to B. Windsor, PO Box 681236, Marietta, GA 30068. Then wear your Lawless America T-Shirt to jury duty. Not a chance you'll be on a jury. Money-back guarantee!
So, you buy a Lawless America shirt and wear it to jury duty so you won't have to serve? Shouldn't these people be chomping at the bit to serve on a jury and protect all the innocent people that are being railroaded by the system? Oh right, not their problem. They'll just make little YouTube videos, start blogs, and whine on Facebook. That's an effective way to get change!!
OMG Joey might have a celebrity visiting him today!!!!!

10-23-2012 -- 10:00 AM -- DALLAS TEXAS: I am leaving in a few minutes for the Ellis County Jail (just visiting). Then I am headed to Houston for filming from 3 pm to 9 pm today.
wow, what a nice guy this Bill Windsor
ReplyDeletehttp://postimage.org/image/y7ixrpruz/
sorry, I forgot to expand a few of the first comments, but there is nothing interesting there anyway.
if you don't read all of it, read the top & scroll about halfway through to where Lawless America speaks again. I guess this Dale (who pointed out Bill's rudeness) donated $5000. Bill says he is going to refund it rather than rephrase. Dear Dale, you are never seeing that money again. Billy boy is gonna eat free for weeks thanks to your charitable donation, but I'd advise against claiming it on your taxes. Bill doesn't look like he's missed too many meals.
these people are insane, how can Bill even take his little project seriously?:
ReplyDeleteGoldie Moore Bill, it was just revealed to me, this world corruption is a pyramid scheme, just like the all seeing eye portrays! All of it! Now who is running it? I believe it is the Pope! Maybe it goes back even Further then the Pope? I am researching something big right now! I believe the Pope owns the Bohemian Grove property? And runs it! Is the Pope doing sacrafices's of our children now> The Jesuit order/ Illumanniti was a started by two Gay Priests! St. Ignatius and Franncis Xavier. Crazier things have happened, you never know?

Brenda Durant Lawless America, I had no idea you were filming; but, my hell led to the exposure of the Texas medical Algorythm Project, drugging for profits, and the guardianships assist with allowing the crimes. This is no he said, she said; it is hard evidence of all the corruptions, even phony advocacy groups. I worked with Allen Jones Pennsylvania O.I>G. Investigator, starting in 2004, after finding blatant corruption and cover-ups at every level of government.
See Dale? Where did the $5K go? Tex Mex. Bill thanks you for the extra side of jalapeños.
ReplyDeleteAww, and look at our wittle wheelie blazer! Daddy Dauben looks star struck!
http://postimage.org/image/xzw7y29nb/
Ok, I'm going to stop looking at things that make my simultaneously angry and confused about mankind.
Well crap, one more thing. Come on Kimberly, get his name right. Really? How long until you figure out it's Dauben & not Daubens? Really?
ReplyDeleteKimberly Harrington Now Mr.Daubens did a great job on his blazer his pride and joy all for justice the Daubens are very good people and i pray they get the justice they deserve, for their Family and son. (Joey G.Daubens) God Bless Them!!!!!!!!!!!!!!!!!!!!!!!!
stooopid.
wow, look how excited he is. His blazer has been popping wheelies all over the country, maybe they can put that on his tombstone as there really isn't anything else to say about him.
ReplyDeletePoor Bill, he is finding out that all his volunteers have mental issues, this is shocking.
Ha. So I got a break and wondered if they were still fighting at Lawless America. It's a Kumbaya moment now:
ReplyDeleteMary Bagnaschi blah blah blah blah . . . . and I Am bold enough to envision a Lawless America Broadway Theater Rock Musical that will incorporate hundreds of the testimonies with 20 of the top New National Anthems that emerge from Lawless America the Soundtrack. The theater production will be enacted in theaters across the Country, raising money and awareness for the City to City Lawless America Law/Civic Rights and Responsibilities Schools
LAWLESS AMERICA THEATER ROCK MUSICAL!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
Now where is Funday when you need him?
Maybe Tony nominated Stark Sands can play Joey Dauben
ReplyDeletehttp://24.media.tumblr.com/tumblr_mc76jlXP7T1rjpo18o1_500.jpg
He'll have to leave the cast of Kinky Boots though, but he's got a great resume including American Idiot.
I've set through quite a few indigency hearings over the years. It is always the responsibility of the appellant to prove they are indigent and it takes paperwork to prove because, I know this will come as a shock, people tend to lie. In fact, in my experience people lie when the truth would serve them better. My experience with the Texas Rangers, though limited, is that they always have their ducks in a row and I expect them to get a conviction.
ReplyDeleteSad thing is that Joey would actually have to make MORE money to be indigent. At this point, he is just a leech. He has debts, but nobody is collecting because they can't find him or they know it is a lost cause. He is capable of holding at least a minimum wage job. If he had a job, had some type of arrangement to pay living costs (even if an agreement to pay his parents a couple hundred a month), and was trying to fulfill obligations regarding debt, he would actually be more likely to be considered indigent. At this point, he's not putting forth any effort so the court is unlikely to reciprocate. He'd also have to be honest about the few things he does own. It's not like the his vehicles amount to any substantial value, but his dishonesty hurts him.
ReplyDeleteI can't believe his parents haven't forced him to step up in the least.
These comments have left yappy speechless, especially the lawless ones. See, miracles CAN happen.
ReplyDeleteYeah someone needs to call Extented Child Protective Services on Cheri and David Dauben for what they are doing to Joey
ReplyDeleteIt's 'cause I stole all the words. I used 'em all up. I caught up with the crazies on fb and then I ran my mouth (well, fingers on keys). Either way, not too many words left for anybody else. Gingersnap needs a penalty box for kids who can't shut up during class.
ReplyDeleteWell, I can tell you this. 903-677-7469 is the bank in Athens, and right below that is a dollar amount... Perhaps the amount in someone's bank account? Who would give joey their account number to have 2 grand in the bank??? To my knowledge he has no bank account with 2 grand in it!
ReplyDeleteI never run out for long, I have storage units full of secret words. shhhhhhh I'll borrow ya some if you need.
ReplyDeleteI'm loving the Funday pics! Homeless Joey n David's lawless t-shirt. Irony is the "Hiring" sign above their heads. rofl. Wonder who Billy's staff were fighting about? Poor Billy e-begging for $500 bucks to pay for hotels? Come on Billy, your son owns a travel company, give him a call, he'll find ya a great deal.
1-800-Scam-Central
Gotta love when a multi gazillionaire is pouting about his FREE staff fighting and whining about others attacking him. How bout we pool money for some thicker skin for Billy.
It could be an amount that he owes on a loan . . . ha ha . . wait, who would give him money? He couldn't even get a payday or car title loan for a few hundred bucks.
ReplyDeleteI saw the Fastline # and knew it was an account. It'd be interesting to know what that sum of money represented was. I think the notes are from Nov 2011.
i hear tell of tale that i will be getting a subpoena today.
ReplyDeletefor the trial next monday in navarro?
ReplyDelete@ b: Who is calling you? Defense or prosecution?
ReplyDeleteOdds are it is the defense. Reason for thinking that: typically prosecution subpoenas (probably should be subpoenae) go out three or more weeks before trial date in felony cases. Defense subpoenas, on the other hand, usually go out a few days before trial date. Among the reasons for this, if the subpoena doesn't get served it gives the defense a chance to ask for a continuance. At least that is my experience.
ReplyDeleteif its the defense that is asking for it, then Joey is really out of ideas.
ReplyDeleteI was thinking this was Joey's doing. But how's that going to go? He trashes B in his *achem* newspapers, calls her names, accusations run wild out of his hiney and then wants to put her on the stand to do what? Save his ass or make HER the fall guy somehow. B, I'd watch your back, Joey's prolly going to put a knife in it.
ReplyDelete@Yappy, here is a theory. Joey is calling B to the stand to back up his theory that the entire known civilized world is plotting against him and has suborned perjury to destroy him and his media empire. She could also testify to his hatred for pedophiles (didn't Jung write something about self-hatred?) so he could not have committed these heinous acts. Of course, no attorney worth the paper his bar card is printed on would use this kind of defense, but Joey may be pulling the reins and his attorney just throwing up his hands.
ReplyDeleteWhere is B with her update?
ReplyDeleteThis is classic Brandy, she likes to give us a tease and then leaves
ReplyDeleteit's annoying, like a school girl . . . .I know a secret, but I'm not telling. fine. keep your mouth shut then
ReplyDeleteIs the case strong against Joey? Does anybody know? What is the evidence?
ReplyDeleteI know it's the Texas Rangers and that's about it. I know he is accused of Oral & Anal sex with a minor boy by testimony, but I don't know if there if actual evidence.
I have no idea of the case against him. Nor when the trial time is (have the date off the other post)
According to Brandy, they have the other witnesses that can attest to Joey and this boy being alone on at least two occasions, one being in a boat and another being in the bathroom. I think they also have some text messages from Joey to the boy after the incident that would lead one to believe they had a special relationship.
ReplyDeleteWell I guess I would actually had to get "served" before I could give an update. "Like a school girl...keep your mouth shut"??? Charming, A-hole, oh imean OReader. Just for that, one more tease. I am being called for the prosecution.
ReplyDeleteIs the trial starting Monday still? I'm hearing rumors that something might be going on today concerning his Ellis county charges
ReplyDeleteJury selection is scheduled to start @ 9 AM on 10/29. Depending on how fast a jury is seated, testimony could also start on Monday.
ReplyDelete@ b: Wow, if Joey is convicted you will have the last word! Karma.
ReplyDeleteYeah, no you wouldn't Brandy. You could have come back and said, "I didn't get anything yet." But, you wouldn't have that kind of consideration. You just "hit and run." It's not like I expect any more from you, so don't worry about it.
ReplyDeleteGingersnap: did we both miss this in Joey's "book"??? Remember after Joey was arrested in Dec, Brandy posted e-mails to/from Joey's accuser with the names redacted? Well, being totally bored today, I made another attempt to wade through the madness. Joey's "book" includes that e-mail exchange with the names not redacted. He printed the kid's name.
ReplyDeleteLooks like Presley is living here now and Joey has successfully infected her with conspiracy-itis.
ReplyDeletePresley Renae Dauben-Tuma Ever seen the movie JFK? Perfect, true example of what happens to those who speak the truth. One of the witnesses was murdered in Midlothian, not too far from where I'm living. They just love to have their enemies die in some "freak accidents". How convenient for them!
I guess I did miss it, but in all honestly, I didn't quite make it all the way through is "book".
ReplyDeleteSorry y'all, I've been on a trolling diet lately - just catching up, one more thing...........
ReplyDeleteForget the judgemental lightening strikes. Connie and her friends appear to believe Hurricane Sandy and the soon to be Frankin-storm are being sent in judgement of folks on the east coast. She's monitoring a FB page for people that think HAARP, if it didn't actually create Sandy, is steering the storm.
hey nothingbetter, did you hear about, or have any way of looking up if Joey had a hearing in Bob Carroll's court today? I'm hearing he did.
ReplyDelete@ Ginger: I called the Navarro court clerk to confirm date/time of their trial. I looked but couldn't find anything on Ellis county at all, figured it was too late in the day to call them for info.
ReplyDeleteI'm really curious about the outcome of the psych exam. Maybe Brannon knows and will weigh in...............
ReplyDeleteI don't remember the chapter number - to save you some time, it was under the chapter about his religious beliefs. He's basically posted his defense.
ReplyDeleteHe also connects the church being located on Grand Ave, near the railroad tracks to being railroaded by the church.
I have not heard of anything, for today nor do I know the outcome of the psych eval
ReplyDeleteThat just reminds me how much Joey's writing style irks me.
ReplyDelete"Nearby Navarro County officials carted out from four years ago an alleged sex-assault victim who falsely accused Joey of gruesome acts."
First the "from four years ago" is totally in the wrong place. Secondly, I know he's going for a visual, but "carted out?" So I'm seeing some lanky 17 year-old lounging in a Target shopping basket as they roll around from the back of the courthouse. I just hate Joey's attempts at illustrations. I find them abrasive and distracting. I don't feel gruesome was the appropriate word choice either. Hacking somebody into bits is gruesome. These allegations might be disturbing or even horrifying, but the use of the word gruesome just brings me back to Joey being overly dramatic. Joey can't present facts in black and white and let the reader draw logical conclusions. He has to slap his voice (and anger) all over it. I guess he thinks people who read what he writes are dumb. He has to do their thinking for them.
Oh, and what conclusions would an average reader draw from this? "Joey was indicted and imprisoned until a reader of his Amber Hagerman articles wired his family $5,000 to get him out of jail." . . . . . . . . Joey's family doesn't even own property that they can put up as collateral for $5000? Or is it they didn't trust that he wouldn't fail to live up to bond restrictions & they'd lose their money? . . . are they that poor, or do they just have no faith in him? A distant stranger has to put up the money?? His family couldn't help nor could a could they find more local donors? 200 people x $25 = $5000. If the kid has 10 papers, that's only 20 readers a paper.
I see random charitable giving almost on a daily basis around the web. I've seen money raised for all kinds of things from medical equipment to transportation to flying a guy from Finland to NYC because it is his life dream. The other day, I saw a $25000 kickstarter fulfilled for somebody writing a children's book about a port wine birthmark. That's 5 times what Joey needed, and Joey supposedly has readers/followers/fans. It took many months and a long distance donation from a stranger to get Joey out of jail for a measly $5K - that speaks volumes.
Oh, and since when is Joey a photographer? Can somebody show me a single well composed photo he has taken?
Oh, and it's a typical Joey article in that it just ends. No wrap-up, no conclusion, it just stops.
ReplyDelete"I guess he thinks people who read what he writes are dumb. He has to do their thinking for them."
ReplyDeleteJudging by the iq's of his remaining fans over at the ECO facebook page, I think that's exactly right.
True, the remaining supporters enjoy their spoon-fed opinions. Even if Joey held the same beliefs and chose the same "investigations," would he have more readers/supporters if he presented dry facts/data without spin? If he welcomed a healthy debate without jumping in to attack, would there be more people on his side even if they thought he saw conspiracy and connect that didn't exist?
ReplyDeleteI have to lean towards, yes. We all have a little conspiracy theorist in us. My neighbor's grass is always greener, but I think it's because he waters secretly during the drought! (nevermind that it's a different type of grass & the guy spends more time fertilizing than I do) If Joey didn't jump straight into snake oil salesman going for the hard sell, maybe he'd have a little more support. Joey makes it clear he doesn't respect anybody that doesn't take his word as the definitive end all. If he showed some respect for a little discourse, maybe he would get a little more respect thrown his direction.
well look at the convoluted way he connects his dots these days. He ties his friend being part of the house that got busted for child porn in ennis into a child porn ring and then to amber hagerman and then on to haily dunn. He also obsesses with dates that can only matter to him such as "this happened on the same day as when I was arrested two years ago". Even if you were trying to agree with him there is no way you can jump all the cliff with him to all his conclusions simply because he says so.
ReplyDeleteoh no doubt he's gone off a cliff & I'm not following, but maybe if he'd been a little less destructive, somebody still at the cliff's edge would do him the favor of cutting the rope that he's tied as a noose around his own neck . . . not to mention the firemen who may or may not bring out the inflatable cushion for him to land on. He might just have a few people that felt sorry enough for him to save him from himself. At this point, he's pissed all the sane people off so much that none have any hope left for him. The only ones he has left are lemmings.
ReplyDelete
