Joey Dauben Can't Even Prove he is Indigent, How is He going to Prove He is Innocent?

This is Joey Dauben trying to contend that he is indigent in his civil case against the state for seizing the ECO. He claims he is indigent because he has a bank account of negative 11 cents, no stocks, bonds or savings. He claims he owes $20,000 in student loans, $5,000 in medical bills, and $2,000 to the ford motor company but in true Dauben style he can't provide one shred of documentation to back that up. He also says that none of the creditors have tried to collect on those debts. He fails to disclose the current car that he is driving as his. Anyway, bottom line is the stupid kid can't even get up there and prove he is indigent, so he has to pay the court costs and that's why he dropped the case.

Some on here wonder why we keep going after his parents, and the evidence from this shows exactly why. David and Cheri Dauben both are actively subsiding Joey and his lifestyle. They admit they are paying for everything for Joey even though they also admit he is more than capable of seeking employment. This isn't just "we are supporting and standing behind our son", this is we are going to continue to financially enable Joey so that he doesn't have to get a real job or enter the real world. They are both terrible parents in just about every category and still to this day they are repeating and doubling down on their mistakes. Joey also fails to mention the massive judgements against him in his civil cases.

  10. Although I am in general agreement with the sentiment posted here the headline for this entry has a basic error in it. Although Joey would be required to prove, by a preponderance of the evidence, that he was indigent to get the filing fees waived in a civil case, he is under no obligation to prove his innocence in the criminal matter. The presumption of innocence requires the State of Texas to prove, beyond a reasonable doubt, that he is guilty of the crime of which he is accused. (BTW, presumption of innocence is only applicable to the court setting, the judge and/or jury must give this presumption, which can be overcome by testimony/evidence, to the accused. It does not require that anyone else, the public, press, authorities, etc., presume he is innocent....only the court). The burden of proof is on the prosecution to overcome this presumption.

    Personally, I believe he is guilty as sin and expect a jury to find the same way....but I believed that of O.J. also.

    I feel bad for everybody involved in the court case. Joey may not fit the definition of insane or incompetent, but he's definitely troubled and holds some really irrational beliefs. Just because he can still function day to day and knows right from wrong doesn't make him right in the head. Yes, I think he's guilty. No, I don't think he'll come up with a viable defense. Yes, I think he should be locked away from the general population. His actions hurt people. But, above all, the kid needs help. If my tax dollars get him the help he desperately needs, I'm OK with that. I won't be holding my breath though.

  26. I've set through quite a few indigency hearings over the years. It is always the responsibility of the appellant to prove they are indigent and it takes paperwork to prove because, I know this will come as a shock, people tend to lie. In fact, in my experience people lie when the truth would serve them better. My experience with the Texas Rangers, though limited, is that they always have their ducks in a row and I expect them to get a conviction.

  27. Sad thing is that Joey would actually have to make MORE money to be indigent. At this point, he is just a leech. He has debts, but nobody is collecting because they can't find him or they know it is a lost cause. He is capable of holding at least a minimum wage job. If he had a job, had some type of arrangement to pay living costs (even if an agreement to pay his parents a couple hundred a month), and was trying to fulfill obligations regarding debt, he would actually be more likely to be considered indigent. At this point, he's not putting forth any effort so the court is unlikely to reciprocate. He'd also have to be honest about the few things he does own. It's not like the his vehicles amount to any substantial value, but his dishonesty hurts him.

    I can't believe his parents haven't forced him to step up in the least.

  36. Odds are it is the defense. Reason for thinking that: typically prosecution subpoenas (probably should be subpoenae) go out three or more weeks before trial date in felony cases. Defense subpoenas, on the other hand, usually go out a few days before trial date. Among the reasons for this, if the subpoena doesn't get served it gives the defense a chance to ask for a continuance. At least that is my experience.

Joey is calling B to the stand to back up his theory that the entire known civilized world is plotting against him and has suborned perjury to destroy him and his media empire. She could also testify to his hatred for pedophiles (didn't Jung write something about self-hatred?) so he could not have committed these heinous acts. Of course, no attorney worth the paper his bar card is printed on would use this kind of defense, but Joey may be pulling the reins and his attorney just throwing up his hands.

    I know it's the Texas Rangers and that's about it. I know he is accused of Oral & Anal sex with a minor boy by testimony, but I don't know if there if actual evidence.

    I have no idea of the case against him. Nor when the trial time is (have the date off the other post)

  44. According to Brandy, they have the other witnesses that can attest to Joey and this boy being alone on at least two occasions, one being in a boat and another being in the bathroom. I think they also have some text messages from Joey to the boy after the incident that would lead one to believe they had a special relationship.

    Jury selection is scheduled to start @ 9 AM on 10/29. Depending on how fast a jury is seated, testimony could also start on Monday.

Well, being totally bored today, I made another attempt to wade through the madness. Joey's "book" includes that e-mail exchange with the names not redacted. He printed the kid's name.

    I don't remember the chapter number - to save you some time, it was under the chapter about his religious beliefs. He's basically posted his defense.

    He also connects the church being located on Grand Ave, near the railroad tracks to being railroaded by the church.

  59. That just reminds me how much Joey's writing style irks me.

    First the "from four years ago" is totally in the wrong place. Secondly, I know he's going for a visual, but "carted out?" So I'm seeing some lanky 17 year-old lounging in a Target shopping basket as they roll around from the back of the courthouse. I just hate Joey's attempts at illustrations. I find them abrasive and distracting. I don't feel gruesome was the appropriate word choice either. Hacking somebody into bits is gruesome. These allegations might be disturbing or even horrifying, but the use of the word gruesome just brings me back to Joey being overly dramatic. Joey can't present facts in black and white and let the reader draw logical conclusions. He has to slap his voice (and anger) all over it. I guess he thinks people who read what he writes are dumb. He has to do their thinking for them.

    Oh, and what conclusions would an average reader draw from this? "Joey was indicted and imprisoned until a reader of his Amber Hagerman articles wired his family $5,000 to get him out of jail." . . . . . . . . Joey's family doesn't even own property that they can put up as collateral for $5000? Or is it they didn't trust that he wouldn't fail to live up to bond restrictions & they'd lose their money? . . . are they that poor, or do they just have no faith in him? A distant stranger has to put up the money?? His family couldn't help nor could a could they find more local donors? 200 people x $25 = $5000. If the kid has 10 papers, that's only 20 readers a paper.

    I see random charitable giving almost on a daily basis around the web. I've seen money raised for all kinds of things from medical equipment to transportation to flying a guy from Finland to NYC because it is his life dream. The other day, I saw a $25000 kickstarter fulfilled for somebody writing a children's book about a port wine birthmark. That's 5 times what Joey needed, and Joey supposedly has readers/followers/fans. It took many months and a long distance donation from a stranger to get Joey out of jail for a measly $5K - that speaks volumes.

    Oh, and since when is Joey a photographer? Can somebody show me a single well composed photo he has taken?

  62. True, the remaining supporters enjoy their spoon-fed opinions. Even if Joey held the same beliefs and chose the same "investigations," would he have more readers/supporters if he presented dry facts/data without spin? If he welcomed a healthy debate without jumping in to attack, would there be more people on his side even if they thought he saw conspiracy and connect that didn't exist?

    I have to lean towards, yes. We all have a little conspiracy theorist in us. My neighbor's grass is always greener, but I think it's because he waters secretly during the drought! (nevermind that it's a different type of grass & the guy spends more time fertilizing than I do) If Joey didn't jump straight into snake oil salesman going for the hard sell, maybe he'd have a little more support. Joey makes it clear he doesn't respect anybody that doesn't take his word as the definitive end all. If he showed some respect for a little discourse, maybe he would get a little more respect thrown his direction.

  63. well look at the convoluted way he connects his dots these days. He ties his friend being part of the house that got busted for child porn in ennis into a child porn ring and then to amber hagerman and then on to haily dunn. He also obsesses with dates that can only matter to him such as "this happened on the same day as when I was arrested two years ago". Even if you were trying to agree with him there is no way you can jump all the cliff with him to all his conclusions simply because he says so.

  64. oh no doubt he's gone off a cliff & I'm not following, but maybe if he'd been a little less destructive, somebody still at the cliff's edge would do him the favor of cutting the rope that he's tied as a noose around his own neck . . . not to mention the firemen who may or may not bring out the inflatable cushion for him to land on. He might just have a few people that felt sorry enough for him to save him from himself. At this point, he's pissed all the sane people off so much that none have any hope left for him. The only ones he has left are lemmings.
