A commenter raised the issue of if Joey broke one of conditions to bail, that being contact with children ie his sister Shelly's kids. Cheri Dauben chimed in to state for the record their contention on this claim, and it is as follows:

I read all of the blogs almost nightly and there is just so much that people comment about that they do not know and understand. I usually do not comment, but when people try to involve my mother and Joeys sisters and her kids, I will have my say. We have gone to great lengths to ensure that Joey and his nephews and nieces do not come in contact.. That is probably the hardest thing about this whole situation. The boys wonder why Presley comes and Joey does not. They love their uncle and he loves them and that is all we can do is reassure them that he wants to be around, but can’t. Presley comes over to do their laundry and she comes to the boy’s baseball games, while Joey goes to a restaurant to wait for the game to be over. I babysit for the kids and come to her house at 5 in the morning and usually do not leave until the kids are in bed after their ballgames. As much as we all would like to be together, we can’t right now. He has missed birthday parties and family get together because of his bond restrictions. Joey has not had contact with his nephews and nieces. PERIOD.
I will say mommy Dauben has always been pretty straight up and right on the point, so I see no reason to not believe her in this contention. I will also say that I think this is a restriction that should be amended. We all have issues with Joey, the State of Texas has issues with Joey. But even if you throw all those issues together, you still wouldn't be able to say that Joey is any kind of threat to his nieces and nephews. Jerry Sandusky was raping anything that still moved under the age of 16 INCLUDING his own kids yet they still let his kids visit him. And jerry is an evil monster we all knew was guilty before it even started. Joey, if his charges are true, would be guilty of having one single encounter 5 years ago between two young boys (one happened to have a drivers license that said he was an adult) experimenting. There is no evidence whatsoever that he is a repeat offender and there certainly is a long enough widow there to judge that by. So this goes out to judge in his case, don't be cruel, amend his restrictions so that Joey can still be Uncle Joey. I have been as hard as anyone on Joey but that's just over the top and uncalled for.
I can say I for one am glad that he does not. Sandusky remarks aside the law is spot on with this order!
ReplyDeleteThis is a good example of "you can't eat your cake and have it too". If the government/system is expected to be responsible for protecting kids, then how can they justify allowing kids to be exposed to people accused of hurting a kid? One, two or twenty kids, it doesn't matter. It is sad that Joey can't be with his family during this time but the Judge doesn't know if the kids are safe - better for the kids' sake to err on the side of caution. Maybe there's evidence to support that Joey has had only one occurence, but maybe that just means he's only gotten caught once. Look how long and how many kids it took before Sandusky was busted.
ReplyDeletehell they even let registered sex offenders see their own family, and those are people who have been convicted or pled to the crime. And I'm sure its just the SOP for people accused of sexual crimes with children, but a little discretion is good here. I mean ok, he doesnt need to be lurking around playgrounds and certianly no more youth camping trips but what would be wrong with seeing his sister's kids who have to be like under 6 years old or so?
ReplyDelete@ Gingersnap: I actually agree with you. If I had a family member in Joey's position, I would resent government restriction - it's my job as a parent to protect my child. On the other hand, I would never leave my child alone with that person for any reason or length of time. My comments are really more related to Presley crying about a corrupt system that doesn' protect kids from pedophiles. Well, Presley - here's your government protection.
ReplyDeleteYeah and I dont see how the conspiracy crowd can explain the sandusky thing. I mean he was the the establishment there in Penn St. and yet they not only convicted him but its going to bring down the entire instiution. I guess they can say that it was covered up by some in the top levels which is true, but it only serves to prove that no widespread conspiracy like that can last. Eventually it all falls apart.
ReplyDeleteWhat's really sad re: Sandusky is that it took 10 boys to convince the jury. Makes you wonder what the verdict would have been if only one boy complained and nobody else had the guts to step up.
ReplyDeleteWell clearly there was a conspiracy by at least 10 individueals because they knew how bad it would make the school look to turn him in. But like any and all conspiracies, the more people that get brought into it the more likely that someone is going to finally blow the whistle as what happened here and happens every single time elsewhere when a conspiracy starts
ReplyDeleteI remember a post on the ECO website a while ago where Joey was mad because someone accused, but not convicted by any evidence, still had custody of their children instead of the mother who was battleing substance use and mental health issues.
ReplyDeleteHmmmm, so the father was accused but not convicted, had custody and the mother had mental issues and/or substance abuse. You left out the one additional criteria and that being that the mother was young and pretty, but other than that you just laid the basic groundwork for a case for Joey to take up. Virtually all of his family court cases fit that criteria.
ReplyDeleteIrony is always high when it comes to ole Joey. Can you all imagine if we Dabuninated Joey on his charges? If we followed his protocol, we would be out in the Wal-Mart parking lots with bullhorns and holding up signs saying "how many kids did you rape today Joey Dauben". I mean if we were to be true Dauben disciples right now, thats what this would call for because thats exactly what he did to others in his position.

ReplyDeleteOh and dont worry, we will go over in detail the court's ruling so everyone on here can see that Presley Dauben has been involved in a conspiracy to kidnap her half sister. Yes Virginia, there are conspiracies but they are usually perpetrated by those who scream conspiracies where ever they go. Just like when someone goes around calling everyone he doesnt know a pedophile, he then is the one that was in fact engaged in the activity.
