Gay Dallas News Source is the Only Outlet Coverning Joey Duaben Now

The Dallas Voice, a LGBT affiliate, has an interesting article up on Joey Dauben with lots of new parts to pick out.

First, apparently Joey has only now been appointed an attorney and that attorney is refusing the case. Joey did confirm, as was reported here, that he is facing charges in Ellis County but they are not true because he is a journalist (too bad they are going to prove he is just a blogger in granny's basement).

Then, there is this paragraph:
"Since his arrest, the Ellis County Observer website has gone down, and Dauben said in the letter that former associates had turned on him, lied about him and taken down the website without his permission. He said legal action would be forthcoming in connection with the alleged misappropriation of his website. Dauben said claims by former associates that he was on suicide watch and that he had admitted to sexually assaulting the teenager are “lies.”"

Ohhh Brandy, you better hope King Joey never gets out of jail because it sounds like this is aimed at you. You lied and said he was on suicide watch, and you let his website go down in flames. His whole life's work crashed into nothing in less than a month. Poor Joey, sitting there in jail alone, with no friends and no trial set because no one wants to take on his case. So Brandy, care to clear up your name, Joey just called you a liar?

  4. I found this part kinda funny: "the Corsicana Daily Sun noted that Dauben had declared himself indigent and filled out paperwork requesting a court-appointed attorney."

    Heh, Joey gets called indigent by a gay newsapaper in dallas

  8. Really, poor Joey. I do feel sorry for him, almost everyday I think about how he is basically right 45 from me and I feel sorry for him but then I get flaming mad.

    I will just clear up these points I am not dropping a tons of bricks, yet. But can anyone tell me where I EVER posted that he admitted to doing anything?

    I hope he gets out. He is a little confused on the order of events but I wouldn't wish someone to go to prison just because they made me mad and they are confused on some things.

    That is what I find most disturbing about all of this, is people who just don't like him, think it is funny he could be looking at 80 years in prison. There were two teenagers the first couple of nights laughing it up on FB about it saying "good let him rot"

    Apparently, he wrote a story about their high school band t-shirts and the haunted house they worked at and it made them mad. So it was funny someone was in jail, possibly prison?!?!

    You do remember the Italy high school, red, hammer and sickle t-shirts? And the haunted house story was completely true, I was there with him when interviewing one of the board of directors. Brutal Brothers S&M porn company was going to run the haunted house that was full of teenagers.

    Both stories true, in my opinion, UNDER REPORTED, and these teens think it is funny because they hate Joey because of two TRUE articles he ran.

  13. Per Steve Keathley's website (the attorney that was appointed, but has apparently chosen not to represent Joey):

    "In 2002, Steve ran for and won the elected position of Criminal District Attorney of Navarro County, Texas and served in that capacity until 2007."

    Perhaps he feels there is some conflict of interest in relation to his position with Navarro County in 2007?

  14. Generally speaking, most Texas counties don't have a "real" public defender. Rather they appoint practicing attorneys (using a "wheel" type system). There are many reasons a person so appointed might request to not be part of a case depending on their regular case load (the counties pay a lot less than normal fees).

    I hope Joey gets adequate representation because I think he is going to need it.

    I agree with Mr. Allison (Frontburner/D Mag). Everyone, no matter what the crime, is entitled to representation and a fair trial. I'd hate to see the case dropped because the State didn't act fairly. But, it looks like Navarro County have pulled their heads out of the sand: Dallas Voice is reporting that Joey has an attorney now. Don't recall the name, but the attorney is in Ellis County.

    Joey is writing to the Dallas Voice - there's a new posting today with a handwritten letter from Joey dated 2/22. He's complaining about a JP, and states the purpose of the letter is "to teach public officials proper conduct".

    In the interest of fairness, he's probably got a point about the JP. But that's where lawyers come in handy. He wrote the letter after his attorney was appointed. I wonder what his attorney thinks of Joey's "activism" from inside the pokey.

    I mistakenly thought JP Chad Adams court would be fair on a minor issue I could handle myself. It was a terrible experience and I learned a lesson: never go into any court without an attorney. By the way, Patrick Wilson prosecuted me, he was an ADA. Mr. Wilson was fair and did his job, I was just unprepared for monkey court. That's also when I learned JP's don't have to have any type of degree, let alone a law degree. Fortunately, I had a lawyer friend that handled my case pro bono in County Court and Adam's ruling was overturned.

    Something else I noticed: David Webb writes for Dallas Voice and the Cedar Creek Lake blog. Joey's letter was sent to David Webb @ Dallas Voice. Surely Joey knows Mr. Webb from his work at Cedar Creek Lake. I'm wondering why Joey chose to specify Dallas Voice. Seems odd.

  28. I remember Joey saying on the ECO that Cedar Creek Lake has a large gay component which I thought was an odd thing to say at the time, maybe he had an intimate knowledge about that.

  30. The problem with public defenders is that they get paid whether they do their job or not. (You get what you paid for, and often with attorneys not even that.) I once had a public defender refuse to follow a direct order from a judge to obtain some vital records, and refused to take my phone calls as his client. I ended up in jail because of it and defrauded out of $30,000 to $50,000 because of his neglect. But HE got paid! Thanks Charles Vaughn!

  31. "Public Defenders" would be a step forward for Ellis. The appointed attorney has no emphasis on defending a client that in Counties like this will probably be found guilty whether or not they are due to Jury preconceived notions, well the police wouldn't arrest him and the DA wouldn't prosecute him and failure to follow laws that say OJ is not guilty, and the attorney will never represent the guy again but will see the Judge and DA every day and he relies on the judge to appoint him really in Ellis the appointed attorney is an arm of the State the Judge is an arm of the State and the DA is usually a political hack trying to get reelected. Its sad but true DA is supposed to seek Justice not moralize or even seek convictions only Justice. to use a recent example look at Joeys Ellis charge. Fraudulent use of identifying info It turns out the charge is because he printed personal information about a guy in conjunction with an accusation of child abuse. The allegation turned out to be false. You have to use it to intend to defraud or harm. analogy is he takes your DL or credit card and tries to use it how is printing that stuff even in the crimes range. Then they take the ECO as contraband. if he had used the credit card to pay the fees of the website yes but how was that info used in a criminal sense.
